Circular regulating the application of the automatic import licensing regime to steel products

On August 7th, 2012, the Ministry of Industry and Trade issued Circular No. 23/2012/TT-BCT regulating the application of the automatic import licensing regime to steel products. Accordingly, importers must apply for an automatic import license to imporing steel products as regulated.

 

- The automatic import license shall be issued by the Ministry of Industry and Trade to importers under the form of certification of application for import of each shipment, valid in 30 days from the date of certification.

 

- Agency issuing the automatic import license: Regional Import-Export Administration Offices under the Ministry of Industry and Trade.

 

- Dossiers applying for an automatic import license shall include: Application form (under a set form); Import Contract; Commercial Invoice; L/C or payment documents or Certification of via-bank payment (under a set form); Bill of Lading or transportation documents of the shipment or report on importing performance (under a set form), in case goods are imported through land borders or from non-tariff zones.

Prior to applying for an automatic import license, importers must register their trader dossiers, including: Registration the signature sample of the competent person or authorized person to sign the Application form for an automatic import license and the seal sample (under a set form); Business Registration Certificate or Investment Certificate or Business License and Certificate of Tax Code Registration (if any).

 

- Application for an automatic import license via internet:

 

+ Declaring information about trader dossiers via the software system as regulated by the Ministry of Industry and Trade and sending the trader dossiers to the agency where the first application for the first automatic import license is submitted.

 

+ After being issued an account to access the system, importers shall declare information about the automatic import dossiers via the system.

 

+ The Ministry of Industry and Trade shall evaluate the information submitted via the internet and notify the importers of the result within 01 day.

 

+ After receiving the notice of acceptance of the Ministry of Industry and Trade, importers shall submit the dossiers to the Licensing Agency as regulated.

 

- The automatic import license shall be issued within 07 working days from the date when the Licensing Agency receives full and valid dossiers from importers. In case importers registers dossiers via the internet, The automatic import license shall be issued within 05 working days.

 

This Circular shall be effective from September 20th, 2012.
