Joint Circular guiding the conditions of import of scraps as materials for production

On November 15, 2012, the Ministry of Industry and Trade – Ministry of Natural Resources and Environment issued Joint Circular No. 34/2012/TTLT-BCT-BTNMT guiding the conditions of import of scraps as materials for production. Accordingly, conditions for scrap importers and for the imported scraps, dossiers applying for a Certificate of satisfaction of conditions, and customs procedures related to the scrap import shall be detailed herein. In which, some details shall be summarized as follows:

 

- Conditions for scrap importers:

 

+ Having stores, yards dedicated to collection of scraps.

 

+ Having technology, equipment for recycling imported scraps as raw materials for production.

 

+ Having a plan, solution to handle imported scraps in order to meet environmental protection requirements.

 

- Imported scraps:

 

+ Being in the List of scraps allowed to import and meeting requirements of the List as regulated.

 

+ Scraps not yet included in the List must be submitted to the Ministry of Natural Resources and Environment for approval.

 

- Dossiers applying for a Certificate of satisfaction of conditions:

 

+ An Application Form (under a set form).

 

+ Corporate Registration Certificate (a copy certified and stamped by the trader).

 

+ A document related to the commitment on environmental protection (a copy certified and stamped by the trader).

 

+ The latest environmental monitoring result, but not later than 06 months (a copy certified and stamped by the trader).

 

The time limit for the provincial Department of Natural Resources and Environment to review and grant the Certificate shall be 15 working days. Each Certificate shall be valid for 03 years and shall not be extended.

 

This Circular shall be effective from January 01, 2013, supersede Joint Circular No. 02/2007/TTLT-BCT-BTNMT dated August 30, 2012 of the Ministry of Industry and Trade – Ministry of Natural Resources and Environment. Traders who have been granted with the Certificates under the provisions of the Joint Circular No. 02/2007/TTLT-BCT-BTNMT shall be allowed to import scraps as regulated within the valid period of the Certificate.
