Regulation on issuance of certificate of eligibility for production and trade in plant protection drugs

On February 25, 2013, the Ministry of Agriculture and Rural Development issued Circular No. 14/2013/TT-BNNPTNT on issuance of certificate of eligibility for production and trade in plant protection drugs. Accordingly, some contents may be summarized as follows:

 

a. Conditionsfor issuance of certificate of eligibility for production, trade in plant protection drugs

 

- Establishments producing plant protection drugs must meet the conditions on workshop, storehouse, equipment, conditions forsafe operation, conditions on fire and explosion prevention and fighting, conditions on quality management system, requirements for environmental protection.

 

- Establishments trading in plant protection drugs, in addition to general conditions, must meet the specific conditions such as the direct manager of the store must have a certificate of plant protection drugs’ trade issued by the Provincial Sub-Department of Plant Protection; having an area in line with business scale of at least 5 square meter (m2) away from water sources,…

 

b. Procedures for issuance of certificate of eligibility for production, trade in plant protection drugs

 

- Procedures for issuance of certificate of eligibility for production of plant protection drugs

Dossiers shall include: Application form (under a set form); Enterprise Registration Certificate or Investment Certificate indicating activities of production, outsourcing, sang chai, packaging of plant protection drugs; Practicing license on production, outsourcing, sang chai, packaging of plant protection drugs of the personnel directly managing the production; Decision on approval of investment project on production works construction in accordance with regulations on construction management, investment (if any); Decision on approval of environmental impact assessment report or environmental protection commitment; fire fighting scheme or report on inspection of fire prevention and fighting safety approved by the district-level fire fighting police; Declaration on conditions for production of plant protection drugs (under a set form).

Number of dossiers: 01 set

Forms of submission of the dossiers: in person or sent by post

Competent authority: Department of Plant Protection

Time limit: within 05 (five) working days

 

- Procedures for issuance of certificate of eligibility for trade in plant protection drugs

Dossiers shall include: Application form (under a set form); Enterprise Registration Certificate with the line of business as trade in plant protection drugs or agricultural materials; Practicing license on plant protection drugs trade of the owner; Declaration on conditions for plant protection drugs trade (under a set form); Decision on approval of environmental impact assessment report or environmental protection commitment.

Number of dossiers: 01 set

Forms of submission of the dossiers: in person or sent by post

Competent authority: Department of plant protection

Time limit: 03 (three) working days for dossiers examination and 07 (seven) working days for the assessment group to conduct actual inspection.

 

 

The Certificate of eligibility for production, trade in plant protection drugs shall be valid in 05 (five) years. After this five-year validity, the facility must submit dossiers for renewal.

 

This Circular shall be effective from April 11, 2013.
